The state Court of Appeals recently ruled that a lawsuit against King County dating to 2006 alleging an improperly designed bus stop should proceed to trial.

In 2006 the victim was sitting in a shelter at a bus stop in the Ballard neighborhood of Seattle when two cars collided in the adjacent intersection, with one of them subsequently careening into the bus stop.

It was determined that two traffic lights were not operating properly and that the bus shelter was oriented so that the victim was facing away from the street and therefore had no warning or time to react to the vehicle that hit him.

The Appeals Court, while not ruling on the merits of the case, held that the case could proceed to trial and that evidence existed that King County may have placed the bus stop in such a manner and location that the victim was placed at risk and that the County could have foreseen the possibility that occupants of the shelter were subject to injury from accidents occurring in the intersection.

If you or a loved one has suffered injury or loss of life in a traffic accident it is important to be mindful that there may be a less obvious party that bears responsibility for the accident – the municipality or entity responsible for properly maintaining safe roadways. Brad Davis of Bradley G. Davis Law Office can assist you in obtaining fair and appropriate compensation for your injuries and at the same time ensuring that all parties bearing responsibility in connection for an accident are held accountable.
